A. GENERAL INFORMATION TO THE AVD MEMBERSHIP
1. WHEN DOES MY MEMBERSHIP IN THE AVD BEGIN AND THE POSSIBILITY TO CALL UPON AVD CLUB SERVICES?
Your AvD membership begins at the point in time that you wish, in as far as the membership form was correctly filled in, is processible, in the domain of the AvD, at the earliest however on the following day at 00.00 hours. You may call upon AvD club services at the earliest 00.00 hours on the day after receipt of your membership form or the later point of time wished by you, when the first contribution was paid in due time; relevant is the receipt of payment at the AvD. Should the first contribution be requested after the beginning of the membership and paid without due delay, the possibility exists to call upon services from the beginning. For incidents that happen before the beginning of the membership no AvD club services may be called upon.
2. WHEN DO I HAVE TO PAY MY CONTRIBUTION?
The contribution must be paid in advance. Follow-up contributions are due at the beginning of the new contribution year and also when a new year of the membership (contribution year) begins.
3. WHEN DOES THE POSSIBILTY END TO CALL UPON AVD CLUB SERVICES?
Membership usually lasts for first one or two years, it extends respectively for a further year, when no later than 3 Months before the expiration date, notice of termination is given via registered letter with return receipt. Relevant is the date of receipt at the AvD. With the end of the membership the possibility also ends to call upon AvD club services. The AvD is not obligated to render services should the first or follow-up contribution not be paid in due time especially when in a demand note the expiration date with irrevocable payment has elapsed. Late contribution payments do not lead to a retrospective entitlement of services.
4. DO I ONLY, HAVE THE POSSIBILITY TO CALL UPON AVD CLUB SERVICES?
As a member of the AvD you personally have the possibility to call upon services. It is not transferable to third parties. An entitlement to reimbursement of costs is not given.
5. WHAT SHOULD BE OBSERVED WITH THE AVD CLUB SERVICES?
The AvD club services are put together accurately and to the best of one's knowledge, for the choice of partners and their services no liability will be assumed. In so far as no special regulations were agreed upon for AvD members, the general terms and conditions of the partners are valid respectively the valid AvD member regulations for AvD club services. All AvD club services are continually up-dated and where necessary explained and published in the AvD club magazine MOTOR UND REISEN as well as other communication resources; please observe the respective terms of validity. Please be aware of, that the AvD can alter at any time the spectrum of their club services, in the type and extent as well as in the composition.
B. THE AVD MEMBERSHIP
1. WHICH SERVICES WILL I RECEIVE AFTER A BREAKDOWN OR AN ACCIDENT IN GERMANY?
After a breakdown or an accident the AvD club services must be requested via the AvD emergency call-centre and include:
– roadside breakdown and accident assistance at the incident location through an AvD roadside patrol mechanic or AvD service partner in order to restore the mobility. A breakdown is where a brake problem exists, the vehicle is inoperative or has broken damage. An accident exists, when an incident immediately and suddenly from outside with mechanical force impacts on the vehicle.
– if help at the incident location is not possible, a tow-away is provided via an AvD roadside patrol or an AvD service partner to the next qualified (trade) garage or to another destination that you may wish for, which is at the most equally distant, including luggage and load; animals and commercially transported goods will not however be transported, when transport with the vehicle is not possible.
The coverage of costs for the AvD club services, breakdown, accident and recovery assistance is not possible, when a reimbursement entitlement against third-parties exists, when identical services for reason of the same cause has already been rendered by third-parties or damage caused with intent or gross negligence. The AvD reserves the right to hold liable, where applicable and retroactive, third-parties.
The AvD has also closed in your interest, a group insurance contract with the Allianz Versicherungs-Aktiengesellschaft, Königinstraße 28, 80802 Munich, by whom you can directly make a claim for settlement. The insurance protection is valid for an incident in Europe (geographical), the non-European Mediterranean states, on Malta und Cyprus, the Canary Islands, the Azores and Madeira; it encompasses approx. the recovery of the vehicle after a breakdown or accident, services after vehicle failure (like onward or return travel), vehicle recovery in case of driver incapability, medical transport repatriation and repatriation of children. An entitlement also exists, when a vehicle is stolen that was registered to the AvD member or is used by him solely and personally. The "general terms and conditions for group insurance" will be sent to you with the documents to the AvD membership.
2. WHAT MUST I DO TO RECEIVE ASSISTANCE AFTER A BREAKDOWN OR AN ACCIDENT?
After a breakdown or an accident always request help from the AvD, also when using the motorway emergency telephones or with the police and identify yourself as a member of the AvD. You can reach the AvD 24 hour emergency call-centre from abroad and inland under +49 69 66 06 600; store this number straight away in your mobile phone! Explain to the call-centre completely and quietly your incident details; follow the questions of the AvD emergency call-centre and their suggestions.
3. FOR WHICH VEHICLE DOES INSURANCE EXIST?
The insurance applies to motorbikes with more than 50 ccm cubic capacity, as a passenger car registered vehicle (exception rental cars, taxis and self drive rented cars) as well as camping vehicles with a permissible maximum weight of 4 t. Coverage is conditional upon the vehicle being driven by the AvD member at the time of the incident.
All particulars apply including loads. A trailer in tow with no more than one axel in the legal sense of the StVZO is insured, not however commercial goods trailers. Not insured are non- roadworthy vehicles, vehicles seized by the police and / or impounded vehicles (or their loads), vehicles for the commercial carriage of persons, non registered vehicles and vehicles used for tests or vehicle transfer, (the last e.g. with red dealer plates).
4. WHAT IS THE WORLDWIDE MEDICAL REPATRIATION TRANSPORT?
For this purpose the AvD has amongst other things closed a group insurance contract for the worldwide medical repatriation transport with the Allianz Versicherungs-Aktiengesellschaft, Königinstraße 28, 80802 Munich, by whom you can directly make a claim for settlement.
The terms and conditions can be requested from the AvD. In the framework of these terms you are entitled to the medically necessary or medically sensible repatriation transport from abroad to a hospital at your place of residence or another appropriate hospital in Germany. The AvD organises this transport for you. Here you can likewise request the help of the AvD. The reimbursement of the costs for the worldwide medical repatriation transport is however not possible when another transport coverage exists.
C. PARTNER (spouse) MEMBERSHIP
1. WHEN CAN I CLOSE SUCH A MEMBERSHIP?
You yourself must name a person that possesses or has applied for a (regular/main) AvD membership and is in consent that you close a partner (spouse) AvD membership. Both memberships (regular and (spouse) partner membership) then exist side by side.
2. HOW DO I PAY THE CONTRIBUTION?
Best for both memberships is from one and the same account. Should you not wish this, the main member pays his contribution as usual himself and she pays her contribution per direct debit from her account. The AvD can invoice the first contribution and let him transfer it.
3. WHAT HAPPENS WHEN THE MAIN MEMBER IS NO LONGER AN AVD MEMBER?
The hitherto (spouse) partner membership will automatically be converted at the end of the main partner membership into their own regular membership.
D. HANDLING OF DATA
1. WHO STORES MY DATA?
Your data is stored and processed for the AvD by the appropriate subsidiary company, the AvD Wirtschaftsdienst GmbH, Frankfurt am Main.
2. WILL MY DATA BE FORWARDED TO THIRD PARTIES?
You agree to,
that the AvD and its affiliated company network, may collect to the extent necessary, general membership and service data
which may result from the application documents or the handling of the membership in the AvD (to contributions, requests for club services or documentation changes)
into shared data collections and may forward it to partners of the AvD,
in as far as it is indispensable for the provision of contractually agreed upon AvD club services (e.g. an AvD service partner or the Allianz Versicherungs-Aktiengesellschaft)
or another sensible, persued concept in the framework of the AvD for the benefit of the members.
Health data may only be transfered to the entrusted service provider (such as emergency intensive care, doctors and emergency services)
3. DO I RECEIVE FURTHER INFORMATION TO THE AVD AND THEIR CLUB SERVICES?
You declare your consent, revocable at any time, that your general membership and service data may be used for your advice and support service within the scope of the AvD membership with regard to all AvD club services and network affiliated companies; this also applies in particular to telephone and written – also where applicable via E-mail - contacts.
